FCPA Sting Defendant Will Plead Guilty

Daniel Alvirez, one of the 22 defendants in the massive “FCPA Sting Case” will plead guilty to conspiracy to violate the Foreign Corrupt Practices Act, according to his attorney Mike Volkov.

 

“He’s going to plead,” Volkov, a partner at Dickinson Wright, told Main Justice late Friday. “He’s going to cooperate.”

 

Volkov said a date for the plea hearing had not been set.

 

Alvirez and coworker Lee Allen Tolleson were charged with conspiracy to violate the FCPA on Dec. 11 in a sealed indictment. The cases’ other 20 defendants also were charged on that day in 15 separate indictments. Alvirez and Tolleson work for defense product manufacturer ALS Technologies, located in Bull Shoals, Ark.

 

The indictments, which were unsealed in January, allege that over two and a half years, the 22 defendants were led to believe they were participating in a bribery scheme to acquire a $15 million contract from the minister of defense of an unnamed African country.

 

The defendants – from both the U.S. and other countries — allegedly agreed to pay a 20 percent bribe to sales agents supposedly representing the defense minister. In reality, the sales agent was an undercover FBI agent.

 

Volkov said Alvirez would plead guilty to new charges alleged in a superseding indictment filed by the government on Friday.

 

Unlike Alivirez’s initial indictment, the superseding indictment explicitly lists the other 22 defendants as co-conspirators.

 

When the indictments were unsealed in January, each was viewed as a separate case. Then, at an arraignment hearing on Feb. 3 in federal court in Washington, Justice Department prosecutors revealed they believed the defendants were all part of one massive conspiracy. The revelation came as a shock to the defense counsel and to Judge Richard Leon, who is presiding over the cases.

 

At the time defense attorneys questioned whether the government had enough evidence to charge a massive conspiracy.

 

According to an individual familiar with the case, Alvirez is a key part of the widespread conspiracy because he introduced many of the defendants to the government’s cooperating witness, Richard Bistrong, who facilitated meetings between the defendants and the undercover FBI agents.

 

The individual also said that other defendants were likely to work out plea agreements and that government is using the cases to go after other defense-industry companies.

 

“They’re looking at historic deals that implicate a lot of other people,” the person said. “They’re building bigger cases and this is going to go deep into the industry.”

According to the individual, the government is interested in corrupt deals in several specific countries, including the Republic of Georgia and Guatemala.

Alvirez’s superseding indictment alleges that while facilitating the sale of military and law enforcement equipment to officials in the Georgian Ministry of Defense, he knowingly used “corrupt sales agents” that were paying bribes to the officials. The indictment also alleges that Alvirez accepted commission payments stemming from the “corrupt deals.”

The superseding indictment also calls for Alvirez to forfeit all funds gained through the deals.
